SAN JOSE (KRON) -- Santa Clara County prosecutors are filing adult charges against three juveniles accused of attacking two Halloween trick or treaters. The two 16-year olds and a 15-year old along with an 18-year old adult all face two counts of attempted murder. Investigators say the defendants attacked a 13-year old boy and a 12-year old girl on Halloween after suggesting their shoes were similar to those worn by members of a rival gang. The alleged attacks happened just after 10:00 p.m. Halloween on Story Road in San Jose. The boy suffered serious stab wounds while the girl was shot. The 12-year old remains critically wounded. Police say the two victims are not gang members. All of the defendants, including 18-year old Eduardo Cristobal of Milpitas, are making appearances in Superior Court Thursday.
