SAN RAFAEL (BCN) -- Six people indicted in connection with the murder of Novato  businessman Tong Van Le last year pleaded not guilty Tuesday in Marin County  Superior Court.

A trial date for the defendants was set for Sept. 28.

Larry Brian Blay Jr., 19, his brother Deandre Maurice Blay, 18, C.  Autis Johnson III, 18, Sean Demetrius Washington, 23, and Kevin Abram, 18,  are charged with Le's murder and the special circumstance of lying in wait,  which exposes the adult defendants to the death penalty.

Johnson, Deandre Blay and Kevin Abram face life without parole.  They were juveniles at the time of the murder.

Anchulita Uribe, 34, Johnson's mother, is charged with being an  accessory after the fact.

Le, 44, witnessed the armed robbery of his business, Nasser Market  in San Francisco on Aug. 23, 2008. San Francisco police arrested Larry Blay  as a suspect but the San Francisco District Attorney's Office dropped the  charges against Blay after Le, it's key witness, was murdered.

The indictment alleges Washington, Deandre Blay, Abram and Johnson  followed Le from the market to his Novato home on Pizarro Avenue in a 1991  Acura Legend on Sept. 13, 2008, and ambushed and killed Le in the garage. Le  was shot once in the head.

Larry Blay allegedly ordered Le killed from his jail cell in the  San Francisco County jail, according to the indictment.
