Update: Child Killed in I-580 Wreck Was Lying in the Cargo Area of Ford Explorer without a Seat Belt
Created by Brian Shields on 11/11/2009 4:43:00 PM

SAN LEANDRO (KRON) -- The CHP says the death of an eight-year old child in a traffic accident Wednesday afternoon in San Leandro could have been prevented if the boy was wearing a seat belt.

"One of the most critical issues here is that this young child along with a 14-year old were lying down in the rear cargo area of a Ford Explorer so they weren't wearing seat belts," Sgt. Trent Cross with the CHP told KRON 4's Heather Donald.  "The young child was ejected and suffered fatal injuries which was very very sad."

Witnesses say other motorists stopped to render aid after seeing the vehicle flip over.  Several people managed to lift the Explorer off of the child but investigators say the little boy was not breathing and had no pulse when paramedics arrived on the scene.  The accident happened on the westbound side of I-580 near the Benedict Drive off-ramp.

The 14-year old and two other victims also suffered minor injuries in the wreck.

"This is one of those things where you have a combination of speed and not wearing a seat belt which led to the death of a very young child which could have totally been prevented," Sgt Cross added.  "This is a very tragic incident."

What? No Compassion?
Based on these posts, it's impossible not to observe that ours is such a vindictive, punitive society. Whoever the driver of this vehicle, s/he will have to live with this tragedy the rest of his/her life, knowing they were negligent. If the driver was a parent, knowing that, they will be severely punished for the rest of his/her life. 10:00:09 knows that there are always two or more sides to a story. The kids could have JUST moments before the accident taken off their seat belts and jumped into the rear cargo area, and the driver waited to find an appropriate place to pull over. WE DON'T KNOW ALL OF THE FACTS, yet look at how many rush to judgment! When one of my kids decides to take advantage of the fact that I'm in the front seat driving and undo his seat belt. I just pull over and tell him that we are going to sit there until he buckles his seat belt, even if it means we sit there all day. But am I able to pull over instantly? No! (I never have to wait very long.)

Your source is wrong..
The child did start off with his seat belt on and he took it off without their knowledge. she did not slam on the breaks she was trying to control the vehicle and overcorrected and the suv started to roll over. It's sad how people will take a story they hear from someone else and run with it. Get a life my family is hurtng and you can't imagine the pain we are feeling right now. If anything you should be praying that this doesn't ever happen to you or anyone in your family.

The person driving should be charged with a crime! No excuses for having people in the rear of the car, kids not wearing seat belts/ being in proper seats (car seat, booster), and driving recklessly! A life is a life! Wrong doing, should be known to an adult!

Stupid drivers
According to a trusted source, the driver of the SUV slammed on the brakes when the vehicle blew out a tire. Stupid driving leads to death.

With all we know today about how easy an accident can happen, there's NEVER a reason to not have your passengers, especially kids, always wearing the seatbelt. So much sympathy for the families involved, so much...
