Man Arrested at BART Station Charged With Three Misdemeanors

OAKLAND (KRON/BCN) – Though BART police had arrested Michael Joseph Gibson on felony charges of battery of a police officer with injury, obstruction and resisting an officer, the Alameda County District Attorney's Office is choosing to only to charge him with the three misdemeanors.

The 37-year-old San Leandro man was arraigned Tuesday on misdemeanor charges of disturbing the peace, being drunk in public and indecent exposure in connection with a confrontation at the West Oakland BART station on Saturday.

Gibson, who is represented by Oakland attorney John Burris, pleaded not guilty and is scheduled to return to Alameda County Superior Court on Dec. 17. Commissioner Karen Rodriguez set his bail at $5,000.

According to BART, witnesses said Gibson appeared to be intoxicated and was yelling racial slurs and profanity at other passengers on a train at the West Oakland station at about 5:40 p.m. Saturday.

A video of the incident shows an officer, whose name hasn't been released, pulling Gibson off the train and across the platform. The officer appears to shove Gibson toward a glass window, which shatters, injuring both men.

Burris tells KRON 4's Mark Danon, the videotape clearly shows Gibson did not assault the officer.

"The most significant part of this to me is that Mr. Gibson, although he was being loud and obnoxious, the officer shouted and attacked him without any real warning to give him an opportunity to comply and then physically manhandled him," Burris said.  "Then to add insult to injury to all of this, the officer charged Mr. Gibson with a felony assault on a police officer when any clear view of the tape demonstrates that it was the officer was the one doing the physically aggressive conduct."

BART spokesman Linton Johnson said the officer suffered facial cuts requiring multiple stitches and a concussion. He notes that Gibson suffered multiple lacerations to his right hand, right forearm and right palm and a minor cut to his head, but that none of his injuries required stitches.

The officer and Gibson were taken to different hospitals and were released later Saturday night.

Johnson said the officer is on industrial leave because he’s unable to perform his duties due to his injuries.

While Gibson was arrested earlier the same day for allegedly attacking an elderly man by kicking the victim in the buttocks, Burris says it makes no difference.

"This man has emotional problems," Burris added.  "There's no doubt about it.  But the officer who engaged in this conduct had no information about that.  His conduct stands on its own.  What he observed and what he did is what really counts here, not what this person's prior history is."

Burris says the officer had better options than to physically confront Gibson who witnesses say was acting unruly and shouting obscenities and racial slurs.

"Any reasonably trained police officer would assess that situation and see this person has a problem," Burris said.  "You don't physically escalate that problem.  What you try to do is calm him down.  You talk softly.  You move slowly.  You don't then attack the person because all you do is exacerbate the situation.  So then the person is totally out of control.  You are physically manhandling him.  You throw him against the wall.  And then you charge him with a crime that he has not committed.  That's outrageous."

Burris has already said he may file a civil lawsuit against BART and the officer over the incident.

His conditions are not a defense. 
I'm tired of being harassed by idiots on the Bart. If I had been there, I would have defended anyone that he bothered and he may have suffered very severe injuries if I had to defend myself.

Police officers are trained to use force,and protec themself. He should have taken this guy down right to the ground when he left the train. I didn't see any need to walk him over to the window. I do understand he might have wanted something to search and secure this guy.To bad this had to come to this. The office did a great job getting him off the train. I am sure the riders where glad to see that bage and blue uniform. I wish that this guy gets the help he needs.

Burris is Smart 
We need more John Burris attorneys out here because there is so much police brutality going on. I hope Burris will take my case of police brutality too. If not can anybody recommend another good attorney?

What does Burris know about handling a person acting drunk, rude, and obnoxious and challenging the rest of the passengers on the train to fight? He is not going to respond to 'talking soft' or 'moving slow'. He would tell the officer to F..O.. Why don't you (Burris) put on the uniform, badge and gunblet and try your 'soft talk' technique and see if you don't get your ass kicked by the suspect. Burris, or should I say Mr Anti-Police, is simply in this for the $$$$$$$$.

FYI for all you folks jumping to conclusions, sis was not getting money, and he just got out of a hospital. Family argued to keep him in a hospital, but our failing system decided he was ok to be on the streets! You want to bash on someone, try Regan for cutting all mental health care programs out! Mr. Michael Gibson arrested at West Oakland BART on Saturday 
The KRON 4 coverage of this story at 5:30 pm today raised doubt as to how the BART station window got broken. Several times I have watched the video footage of this incident that was posted to Youtube and aired on local television news. This Youtube video clearly and unambiguously shows the BART police officer breaking the window with Mr. Gibson's head. Based on the Youtube video, there is no question and no doubt. -HKF

Travesty of Justice 
Gibson hasn't even gotten a slap on the wrist in the past for the various assaults he has committed. Two of those were on very vulnerable people, i.e., an elderly man and a pregnant woman. Now he has caused serious injuries to a police officer by punching the glass at the BART station. Either lock him up or put him in a mental institution, but do not allow him to run amok again because that is what he will do at the next opportunity.

John Burris has no clue what it must be like to be a police officer. Manhandled?? Are you kidding?? What is he supposed to do? Ask him politely to leave the train?? Give me a break. The officer had to take control of the situation. He has to be forceful or that cannot be achieved. Please Burris get a clue!!! These thugs that cause the problem in the first place are the problem. We should thank these officers every day for putting up with scumbags that terrorize others.

The only issue to consider here 
This man's fault or the fault of any of his family members, is not the issue here. I just hope I'm not on a walkway the next time a police loses his temper and slams someone's head through a pane of glass above me (remember they were up on the platform). The officer shoved the suspect's head into the glass - plain and simple. He is just as guilty and yet he filed a felony assault by this man for his own criminal act. POLICE ARE NOT ABOVE THE LAW.

I'm curious why no one's talking about the 82 year old man that Gibson kicked in the teeth earlier that day in Daly City. Where was Burris to deffend the elderly victim ????

The man should be held responsible 
If this man had access to healthcare and medication and he refused to take his medication then he should be held accountable for his actions when not medicated. Had he taken his meds properly then this incident probably never would have happened. Like everyone else in the Bay area, my husband and I have seen this video many times and think the officer acted appropriately. As someone suffering from a mental illness I would never put the well being of those around me in jeopardy by neglecting my responsibility to care for myself accordingly. Shame on this man for making people with mental illness look bad and shame on him for making the police officer look bad.

New Comment Sorry I disagree! I knew those charges was not going to stick. It was clear that he was not resisting and willing followed the cop off the bart. He didn't swing or try to run he was slammed into a window which was broken due to excessive force. Way out of line! Sorry he must have not been in a good mood. You get what you deserve! The citizen was clearly a problem but didn't deserve that abuse! You plant what you grow!

The cop did the right thing. Burris suggest he should chatted with him first. Well, the video clearly shows that Gibson was in no state for a calming down discussion. The cop took the cautious measure of defusing the situation to protect himself and the general public. I'm amazed that the by-standers didn't quickly assist the officer instead of shooting video. The glass breaking looked like a fluke (he didn't put him against it that hard), and keep in mind we didn't see in the video much prior to the officer taking action. Thanks for keeping BART safe officers!

Bart should press charges on sister 
The sister said she knew he was bipolar, and schizophrenic, yet she let him roam and terrorize. She's probably getting money from the State for taking care of him. Burris sure gets around.
