SAN RAFAEL (BCN) -- A San Rafael man convicted of five felony counts in connection with the rape of a female hiker at a Stinson Beach campsite more than four years ago was sentenced to 33 years to life in prison Tuesday.
Terry Ray Hawes, 46, was convicted in Marin County Superior Court last summer of two counts of rape with a foreign object, attempted forcible rape, criminal threats and assault with intent to commit rape.
A jury convicted him in June of four counts but deadlocked 11-1 on one count of rape with a foreign object. A second jury convicted him of that charge in July.
Defense attorney Jon Rankin said Judge Kelly Simmons sentenced Hawes to 15 years to life on an enhancement alleging he caused great bodily injury to the victim during the rape with a foreign object.
Hawes was sentenced to an additional 18 years in prison on the five felony counts, Rankin said.
Deputy District Attorney Aicha Mievis said the female hiker, who was 28 at the time of the crimes, which occurred on Aug. 13 and 14, 2005, had a conversation with Hawes outside a market in Stinson Beach and then went to her campsite. She said Hawes followed her there and assaulted her twice. She flagged down a motorist and escaped the next day.
Police agencies along the North Coast searched for Hawes, known as a drifter, and he was arrested at a Santa Cruz homeless shelter in August 2005.
A tattoo of an outline of a marijuana leaf on Hawes' upper back led authorities to identify him as the rape suspect.
The case was suspended twice when Hawes was found incompetent to stand trial. He spent time in Atascadero State Hospital for treatment of schizophrenia until he was determined to be competent.
Rankin said he asked Simmons for a 25-years-to-life sentence. Mieves asked for a 36-years-to-life term.
"Unfortunately, this man had a long undetected mental health issue and it's unfair there was no place for him between the streets and prison," Rankin said.
